Basic Provisions

These Terms and Conditions define the rights and obligations of the Contracting Parties, namely:

(A private individual or a natural or legal person purchasing a product or products offered by the Seller through thee-shop houseofteas.eu)

(hereinafter referred to as the "Customer")

The Terms and Conditions form an integral part of the Order - in this case, the Order means a confirmed order placed through the e-shop houseofteas.eu.

An Order cannot be confirmed without the Customer agreeing to these Terms and Conditions.

houseofteas.eu is an online store through which the Seller offers and sells teas, tea products, and tea accessories (hereinafter referred to as "products" and/or "goods").

We will respond to customer queries or requests as soon as possible, but no later than three working days from their receipt.


Product Offer and Availability

The product offer available in the e-shop houseofteas.eu is updated continuously based on the availability of individual product types.

The Seller does not guarantee the continuous availability of all products. The product offer depends on restocking possibilities, which may be influenced by third parties or unpredictable natural conditions.


Product Prices

Product prices are stated in euros and include VAT.

The Seller reserves the right to adjust product prices. These adjustments take effect upon their publication in the online store cajovydom.sk.

For the Customer, the applicable prices are those valid on the day of purchase, i.e., the day of order confirmation.

Promotional prices and quantity discounts indicated for products are valid at the time of confirmation of the order via the online store apply to online orders and cannot be claimed when purchasing without an online order in the store.


Ordering

An order can only be placed through our e-shop at houseofteas.eu. After submitting an order, the Customer will receive a confirmation email including a summary of the entire order.

A received order is binding, and upon receipt of the confirmation email, a purchase agreement (hereinafter referred to as the "Agreement") is formed between the Buyer and the Seller.

Orders cannot be placed via phone, email, or any other method outside our e-shop system.

An order serves as proof of purchase and includes:

  • List of products, including quantity, unit price, and total price with VAT
  • Delivery method
  • Payment method
  • Total order price, including delivery charges
  • Customer details required for delivery and invoice issuance:

    • Name and surname
    • Delivery address
    • Email
    • Telephone number
  • Billing details:
    • Name and surname
    • Company/organisation name (if applicable)
    • Billing address
    • Company ID (if applicable)
    • Tax ID (DIČ) (if applicable)
    • VAT ID (IČ DPH) (if applicable)

Each order can be modified before submission by returning to the previous step in the purchase process.


Order Confirmation

Before submitting an order, the Customer must confirm their agreement to these Terms and Conditions by checking the checkbox next to the Terms and Conditions link. These are displayed prominently above the "Confirm Order" button.

An order cannot be submitted without confirming agreement to the Terms and Conditions.

By submitting an order, which is executed by clicking the "Confirm Order" button, and by the Seller confirming receipt of the order via email, a contractual relationship is established between the Seller and the Customer. The rights and obligations of the contracting parties are defined in the Terms and Conditions.


Delivery Methods

The Seller offers the following delivery methods:

  • Courier Service
    Express courier delivery to the Customer's address
    Available for all Customers
  • Packeta "PickUp Point"
    Delivery service to a pickup point of the Customer's choice
    Available for Customers in EU countries where Packeta operates
  • Packeta "Home Delivery"
    Home delivery service to the Customer's address
    Available for Customers in EU countries where Packeta operates (excluding Slovakia)
  • Personal Collection
    Collection in person at Čajový Dom, Povraznícka 2, Bratislava, Slovakia
    Available for Customers who can collect their order within five days of receiving a notification that it is ready
    If a personal collection order is not picked up within five working days, it will be cancelled.

Delivery Charges

A delivery charge (packaging and shipment costs) is added to the order's price. The amount depends on the selected delivery method and the destination country.

Prices for delivery within Slovakia:

For retail customers

    If the order price exceeds €100, its delivery by courier service to the Customer's delivery address within the Slovak Republic is free of charge.
  • Packeta PickUp Point + from €5.00
    If the order price exceeds €100, its delivery by Packet to the collection point of the Customer's choice within the Slovak Republic is free of charge.
  • Personal collection + €0.00 (free of charge)

For wholesale customers

  • Courier + from€7.00
  • Packeta PickUp Point + from€6.00
  • Personal collection + €0.00 (free of charge)
  • Prices for delivery within the Czech Republic:

For retail customers

  • Courier service + from €8.00
  • Packeta (Zásilkovna) PickUp Point + from €5.00
    If the order price exceeds €100, its delivery by Packeta to the collection point of the Customer's choice within the Czech Republic is free of charge.
  • Packeta (Zásilkovna) Home Delivery + from €7.00
    If the order price exceeds €100, its delivery by Packeta to the Customer's delivery address within the Czech Republicis free of charge.

For wholesale customers

  • Courier service + from €10.00
  • Packeta(Zásilkovna) PickUp Point + from €7.00
  • Packeta (Zásilkovna) Home Delivery + from €9.00

Prices for delivery within other EU countries (except Slovakia and the Czech Republic):

Payment methods

The customer has the option to choose from the following payment methods:

  • Online payment by card
  • Cash/card on delivery
  • Bank transfer (just scan QR code to pay)
  • In person (cash/card) at the store

Availability of payment methods depending on the method and country of delivery:

  • Online payment by card
    This payment method is available to all retail customers within Slovakia for all delivery methods
  • Cash/card on delivery
    This payment method is available to all retail customers within Slovakia for delivery by courier service or to a Packeta collection point
  • Bank transfer
    This payment method is available to all wholesale customers within Slovakia and other customers for delivery by courier service, to a Packeta collection point or by Packeta to the delivery address
  • In person (cash/card) at the store
    This payment method is available to all customers for personal collection

Order cancellation

An order can be canceled within 3 hours via our Customer Service:

When canceling an order, it is necessary to provide the order number, name of the customer and contact information for its identification.

The order cancellation will be processed by our Customer Service, which will contact the customer if necessary to verify or supplement the data.

The order cancellation is confirmed by e-mail to the e-mail address specified in the order or by phone.

If the order has already been paid, the seller is obliged to return the paid amount to the customer no later than 14 days after confirming the cancellation.


Withdrawal from the purchase and sales contract

The Buyer has the right to withdraw from the contract without giving a reason within 14 working days from the date of delivery of the goods, pursuant to Section 12 of Act 108/2000 Coll., as amended. The goods must be returned undamaged and in their original packaging.

The Customer must notify the Seller of the withdrawal from the contract in one of the following ways:

When withdrawing, it is necessary to state the order number, date of purchase and attach the original proof of purchase of the goods.


Return of goods

If the buyer has already received the goods, he is obliged to return the goods to the seller when withdrawing from the contract.

Send the goods by registered mail and insured (not cash on delivery) under the following conditions:

  • The goods should be returned in the original undamaged packaging (if this is not the case, see the next point)
  • The goods must not be used
  • The goods must be undamaged
  • The goods must be complete (including accessories, warranty card, instructions, etc.)
  • In the event that the goods are returned to the seller in a condition other than the original undamaged condition and packaging, the buyer is obliged to reimburse the seller for the costs associated with restoring the goods to their original condition and any damage to the goods (damaged packaging, incomplete contents, worn or soiled goods, etc.).

For better processing, please fill out and attach this form to the returned goods.

The costs associated with returning the goods by mail are borne by the customer.

Via Packeta (from countries where Packeta operates):

You can return the package free of charge at any Packet delivery point. We will provide you with the numerical code for returning the package upon request. Please write us an e-mail at eshop@cajovydom.sk or call +421 944 161 967.

The seller is obliged to take over the goods and return the price paid for the goods to the consumer no later than 14 days from the date of delivery of the returned goods, including the costs associated with the delivery of the goods.


Dispatch and Delivery of the Order

The order is usually dispatched within three business days of receipt. The Customer is informed about the dispatch of the order via email. We also notify the Customer about personal collection via SMS.

The order is delivered to the address that the Customer has provided as the delivery address or to the Packeta collection point selected by the Customer.

If the Seller needs to extend the delivery time of the order, the Customer will be contacted by our Customer Service team.


Repeated Dispatch of Goods

If you fail to collect the goods due to your own fault, we can resend them to you upon request, and you will bear all costs associated with re-delivery. IIn such a case, we will dispatch the goods only after the amount for repeated delivery has been paid to our bank account.


Warranty Conditions and Liability for Damage

The delivered order includes an invoice (tax document), which also serves as both a delivery and warranty certificate.

The Customer must retain the invoice and present it to the Seller upon request in the event of a complaint.

The warranty period within the EU is 24 months. For food items, such as tea and tea products, the warranty period is indicated on the packaging as the minimum durability date or expiry date.

The warranty does not apply to damage to the goods caused by inappropriate storage and exposure of the goods to conditions that are contrary to the recommendations of the manufacturer or Seller, as well as rough handling.


Complaints

The Seller undertakes to deliver the goods in the quality and quantity specified in the order.

The Customer must inspect the delivered goods upon receipt and report any damage or discrepancies to the Seller as soon as possible.

Complaints may be made for goods that have not been damaged due to improper storage, exposure to unsuitable conditions, or rough handling.

Complaints are handled by the Seller's Customer Service team in writing via email at eshop@cajovydom.sk or at the following address:

The Seller is obliged to process complaints within 30 days.

Complaints apply exclusively to orders placed through the e-shop houseofteas.eu.


Resolution of consumer disputes through the online European ODR platform

Since February 15, 2016, you can also exercise any of your rights and claims against us within the framework of an alternative online dispute resolution. Online dispute resolution is provided by the European Commission and the Slovak contact point for online dispute resolution (ODR). Our claims against you can also be exercised through the European platform.

You can file a complaint through the online dispute resolution (ODR) platform at http://ec.europa.eu/consumers/odr/index_en.htm.

Using alternative dispute resolution saves money and time, as your complaint will be resolved within 90 days and without significant financial expenses.

Personal data protection

In the e-shop houseofteas.eu, we fully respect your privacy. In order to provide full-fledged services, we need to know some of your personal data. Some data provided when using the store's services are personal data within the meaning of Act No. 52/1998 Coll. on the protection of personal data in information systems. The online store cajovydom.sk is fully governed by this law.

In connection with the introduction of new legislation in the field of personal data protection - Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the "GDPR") and the implementation of measures to ensure compliance by Tea Trade Slovakia, s.r.o. with the GDPR as well as with the related relevant legal regulations governing the protection of personal data (e.g. Act No. 18/2018 Coll. on the Protection of Personal Data and on Amendments and Supplements to Certain Acts, Decrees of the Office for Personal Data Protection of the Slovak Republic), customers can find the general information obligation regarding the protection of personal data on the Personal Data Protection page.

For the purposes of communication and order processing, the Customer enters his personal data into the forms of the e-shop houseofteas.eu.

By submitting the form, the Customer confirms his consent to the use of personal data for the purposes of:

  • delivery of the order,
  • communication with him by the Seller's Customer Service,
  • processing of the accounting of the online store cajovydom.sk,
  • important technical announcements and information,

By confirming the forms for the Newsletter, the Customer also gives his consent to the use of personal data for the purposes of:

  • sending information about news and promotions of the online store cajovydom.sk to the Customer's e-mail address
  • other marketing communication

All personal data will be stored in the database of the e-shop houseofteas.eu, which is managed on a secure server.

The Seller is responsible for the safe storage of personal data and also undertakes that this data will not be provided to third parties, except in the case of a third party responsible for the delivery of orders, processing of accounting and processing of competitions and other marketing communication of the online store.

The customer confirms his consent to the unlimited storage of personal data provided when purchasing in the online store cajovydom.sk. This consent can be revoked at any time in writing, however, for accounting purposes it is necessary to store them in the warehouse system for at least 10 years.


Availability and use of the online store

The online store cajovydom.sk is intended exclusively for the purchase of products offered in its catalog.

The seller, who is the operator of the online store cajovydom.sk, does not guarantee its uninterrupted operation and is not responsible for damages incurred by the customer in the event of the impossibility of fulfilling the order due to a failure or interruption of the online store.

All information and photographs published within the online store cajovydom.sk are the exclusive property of the operator, which is Tea Trade Slovakia, s.r.o. and their further use is not possible without its express consent.


Final provisions

These Terms and Conditions shall enter into force on the date of their publication on the website of the e-shop houseofteas.eu The Seller reserves the right to change them without prior notice.

The Customer agrees to these Terms and Conditions by checking the box next to the sentence "I agree to the Terms and Conditions" and subsequently confirming the order by clicking on the "Finish order" button.

Conditions and relationships that are not defined in these Terms and Conditions are subject to the relevant provisions of the law and legal regulations valid in the Slovak Republic.
